The new Assisted Decision Making (Capacity) Act 2015 is currently awaiting a ‘commencement order’ by the government. It should be fully in place by the end of 2016. The system of Wards of Court will then be phased out over a three year period. In addition there will be a range of decision-making supports in place to enable people to make their own decisions as far as possible.
